§ 1.General provisions
- These Terms set out the rules for using the pewnawoda.pl website (the “Site”), including creating accounts, booking pegs at commercial fisheries, buying e-permits, entering competitions and publishing reviews.
- The Site is in beta. Fisheries marked as samples serve only to show how the Site works. Bookings at such fisheries are demonstrations: they involve no payment and give no right to use the fishery.
- These Terms are available free of charge at pewnawoda.pl/regulamin in a form that allows them to be downloaded, saved and printed. Creating an account requires reading and accepting these Terms.
§ 2.Definitions
The terms used in these Terms mean:
- Operator — the entity running the Site, identified in § 3.
- User — a natural person, legal person or organisational unit using the Site.
- Angler — a User who uses the Site to find a fishery, book a stay, buy an e-permit or take part in competitions.
- Owner — a User running a commercial fishery who, after verification, publishes its offer on the Site.
- Fishery — a commercial fishery described on the Site by an Owner.
- Booking — an agreement for the use of a peg or a Fishery on specified dates, concluded between an Angler and an Owner through the Site.
- E-permit — a permit issued in the holder's name for recreational fishing at a given Fishery, issued by the Owner in electronic form with a QR code.
- Consumer — a natural person concluding an agreement not directly related to their business or professional activity. The provisions on Consumers also apply to a natural person running a business where the agreement is not of a professional nature for them.
- Commission — the Operator's fee, paid by the Owner, for acting as an intermediary in Bookings paid online.
§ 3.Site operator
- The Site is operated by Filip Piątek.
- You can contact the Operator by email at kontakt@pewnawoda.pl or via the form at pewnawoda.pl/kontakt.
Beta version
We will publish the Operator's full registration details (legal form, address, NIP and REGON) before online payments are launched. Until then, use the form at pewnawoda.pl/kontakt in any matter concerning the service.
§ 4.Technical requirements and rules of use
- To use the Site, you need a device with internet access, an up-to-date browser with JavaScript enabled and the cookies required for logging in allowed, and an active email address.
- The Operator takes care to keep the Site running without interruption but may temporarily limit its availability, e.g. during maintenance work. Where possible, the Operator announces planned interruptions in advance.
- It is prohibited to provide unlawful content or to take actions that disrupt the operation of the Site, including bulk automated data collection without the Operator's consent.
§ 5.User account
- Creating and maintaining an account is free of charge. The account agreement is concluded for an indefinite period when the account is created.
- To create an account, you provide your name, email address and password, or log in with a Google account if this option is available. The User provides true information and does not share their password with others.
- The User may delete their account at any time in the account settings or by emailing kontakt@pewnawoda.pl from the address linked to the account. Deleting the account does not affect paid Bookings or obligations arising from the law — the Operator keeps billing data for as long as the law requires.
- The Operator may block the account of a User who seriously or persistently breaches these Terms or the law, e.g. by publishing unlawful content or attempting fraud. Where possible, and provided it does not endanger the safety of others, the Operator informs the User of the reason for the block. The decision may be challenged by submitting a complaint (§ 16).
§ 6.Owner account and verification
- The Owner creates an owner account and provides contact details and, if they run a business, also the business name and NIP (tax ID).
- Before a Fishery is published, the Operator verifies the Owner's account and the Fishery details, usually within 48 hours. The Operator may request additional information or documents. If verification is refused, the Owner receives the reasons and may apply again.
- The Owner is responsible for ensuring that the Fishery description matches reality (prices, fishery rules, cancellation policy, peg availability) and for holding the rights to run the Fishery and to issue fishing permits.
- The Owner grants the Operator a non-exclusive, royalty-free licence to display photos and descriptions of the Fishery on the Site and in materials promoting the Site, for as long as the Fishery is listed on the Site. The Owner declares that they hold the rights to the materials they publish.
- The Operator may suspend a Fishery if its description is misleading, the Owner breaches these Terms, or repeated, justified complaints are received about the Fishery. The Owner receives the reasons for the suspension and may challenge it through the complaints procedure (§ 16).
- The Operator may terminate the agreement with an Owner on 30 days' notice, stating the reasons. Termination without notice is possible only in cases provided for by law, in particular in the event of serious or repeated breaches of these Terms.
§ 7.Bookings
- The Site acts as an intermediary in concluding Bookings. The parties to the agreement for the use of a Fishery are the Angler and the Owner. The Operator is not a party to that agreement and does not provide services at the Fishery.
- Before making a Booking, the Angler sees: the Fishery and peg (if applicable), the dates, the number of people, the total price including extras, the payment method and the cancellation policy. The price shown before confirmation is the final price.
- A Booking is made when the confirmation button is clicked or, if the Fishery requires online payment, once the payment has been made. The Angler receives a confirmation with the Booking code by email and in their account.
- Some Fisheries confirm Bookings manually. If the Owner rejects a Booking, the Angler receives a refund of the full amount paid.
- The Angler complies with the Fishery rules. The Owner may refuse entry to, or end the stay of, a person who seriously breaches the Fishery rules.
§ 8.Payments
- Online payments are processed by Stripe Payments Europe, Ltd. (Ireland). Available methods include BLIK, payment card and Przelewy24. Payment card data is processed exclusively by Stripe — the Operator does not receive it.
- If a Fishery offers payment on site, the Angler pays the Owner directly.
- Prices on the Site are given in Polish zloty (PLN) and are gross prices.
- Funds from Bookings paid online are settled with the Owner after the Angler arrives, minus the Commission. Voluntary restocking donations go to the Owner without Commission.
§ 9.Booking cancellations and refunds
- The cancellation policy is set by the Owner for each Fishery. The Site shows it before a Booking is made and in the Booking details. Typically, free cancellation is possible up to a specified number of days before arrival, followed by a partial refund or no refund.
- The Angler cancels a Booking in their account. The refund amount depends on the Fishery's policy and the cancellation date, and is shown before the cancellation is confirmed. Refunds are made using the same payment method.
- If the Owner cancels or rejects a Booking, the Angler receives a refund of the full amount paid.
- Under Article 38(1)(12) of the Polish Consumer Rights Act of 30 May 2014, the right to withdraw from a distance contract does not apply to services related to leisure activities where the contract specifies the day or period of performance. This applies to Bookings and E-permits for specific dates. It does not limit the possibility of cancelling a Booking under the Fishery's policy.
§ 10.E-permits
- E-permits are issued by the Fishery Owner. The Site enables them to be bought, stored in the Angler's account and checked by the water.
- An E-permit is issued in the holder's name and is valid at the specified Fishery, for the period and number of rods stated at purchase. It does not replace a fishing licence or other documents required by law.
- The E-permit QR code is cryptographically signed. It is prohibited to pass it on to anyone other than the person to whom the permit was issued, or to modify it.
- The Owner may revoke the E-permit of a person who breaches the Fishery rules. Any refund is governed by the Fishery rules.
§ 11.Competitions
- Competitions are organised by the Owner or by an organiser designated by them, who sets the competition rules, entry fee, scoring rules and prizes. The Site enables entries, payment of entry fees and publication of results.
- The Operator does not charge Commission on entry fees. Entry fee refunds are governed by the competition rules.
§ 12.Reviews and User content
- An Angler may publish a review of a Fishery. A review should describe the author's own experience of the Fishery.
- The Owner decides who can add a review of their Fishery: any logged-in User, only people who booked a stay through the Site, or only Anglers verified by the Owner. With the “any logged-in User” setting, the Operator does not check whether the author of a review actually visited the Fishery.
- Unlawful, offensive or misleading content, advertising, and reviews published in exchange for benefits or by persons connected with the Fishery are prohibited.
- The Owner may reply to a review and report it for moderation. The Operator may hide a review that breaches these Terms. The decision does not depend on whether the review is positive or negative.
- Anyone may report content they consider unlawful by emailing kontakt@pewnawoda.pl with the page address, a description of the content and the reasons. The Operator deals with reports without undue delay and communicates its decision.
- By publishing content, the User grants the Operator a non-exclusive, royalty-free licence to display it on the Site for as long as it remains published.
§ 13.Fees for Owners
- Adding a Fishery and using the Start plan are free of charge. On the Start plan, the Operator charges a Commission of 8% on Bookings paid online.
- The Premium plan costs PLN 99.99 per month or PLN 899.99 per year and reduces the Commission to 4%. Current rates and the scope of each plan are always given in the price list at pewnawoda.pl/cennik.
- The Commission does not apply to Bookings paid on site, E-permits, entry fees or restocking donations.
- The Operator notifies Owners of any change to Commission rates or plan prices at least 15 days in advance. The change does not apply to Bookings already paid.
- The order of Fisheries in search results depends primarily on how well they match the search criteria (location, species, methods, facilities, dates), on distance and on Angler ratings. Fisheries on the Premium plan may be featured in the results — featured placement is labelled as such.
§ 15.Liability
- The Operator is responsible for the proper operation of the Site as a tool for searching, booking and payments. The Owner is responsible for the services provided at the Fishery — the condition of the fishery, stocking, facilities and consistency with the description.
- The Operator is not responsible for catch results or weather conditions.
- Provisions of these Terms limiting liability do not apply to Consumers to the extent that the law prohibits such limitation.
§ 16.Complaints
- Complaints about the operation of the Site — e.g. payments, Bookings, E-permits, accounts or the Operator's decisions — can be sent to kontakt@pewnawoda.pl. In your complaint, include your contact details, the Booking code (if applicable) and a description of the problem.
- The Operator deals with a complaint within 14 days of receiving it and replies by email.
- Complaints about services at a Fishery should be directed to the Owner. The Operator helps with getting in touch and, if necessary, with clarifying the matter.
- Owners may submit complaints about the operation of the Site, including decisions to suspend a Fishery, through the same procedure.
- A Consumer may use out-of-court dispute resolution methods, e.g. the assistance of a municipal or district consumer ombudsman (rzecznik konsumentów) or the provincial inspectorate of the Trade Inspection (Inspekcja Handlowa). More information: uokik.gov.pl.
§ 17.Personal data
- The rules for processing personal data are set out in the Privacy Policy available at pewnawoda.pl/polityka-prywatnosci.
- The Owner receives the Angler's data (full name, email, phone number, booking notes) to the extent necessary to fulfil a Booking, an E-permit or a competition, and to that extent is a separate controller of that data.
§ 18.Changes to the Terms
- The Operator may amend these Terms for important reasons, such as changes in the law, in the scope of services or in prices. The Operator announces changes on the Site and by email at least 14 days before they take effect, and to Owners at least 15 days in advance.
- Changes do not apply to Bookings made before they take effect. A User who does not accept the changes may delete their account before the date on which they take effect.
§ 19.Final provisions
- These Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with Consumers are resolved by the courts having jurisdiction under the general rules.
- These Terms are available in Polish, English, German, Czech and Slovak. In the event of any discrepancy, the Polish version prevails.
- These Terms apply from 4 October 2026.
